1. General

By accessing and using the website, the user expressly accepts, without any reservation, the terms of use and undertakes to comply with these terms of use. A 'user' (hereinafter also referred to as 'you') within the meaning of these Terms of Use is anyone who visits and uses our website to collect information, regardless of whether they register or not.

The user is also expected to take cognisance of our Privacy Statement as well as any other rights and obligations that are clearly mentioned on the website.

Fedustria reserves the right to amend the provisions of these terms of use and the user shall be expected to reread these terms before each new use.

2. Registration

Registration may be necessary. In such case, users who wish to access certain functionalities and specific information on our website must register. In order to be able to register, the user must have reached the age of 18. Fedustria shall be entirely free to determine the conditions for registration at its own discretion and to modify these at any time.

Registration by a minor (aged under 18) shall only be permitted with the express prior consent of the parent(s) or legal guardian.

On registration, the user must create a personal profile (hereinafter referred to as 'user profile') based on accurate, truthful, current and complete data. Depending on the capacity of the user, it may be absolutely necessary to include certain information.

This obligation shall apply both during the creation of the user profile and in future. It shall be the exclusive responsibility of the user to correct or delete any out-of-date data.

Each user profile shall be strictly individual, personal and confidential. Users shall not be entitled to transfer their user profiles to third parties without the express consent of Fedustria. The user shall be exclusively responsible for all actions carried out with the user profile, and shall also ensure the confidentiality of the user profile, including the login data.

Users shall notify Fedustria of any breach of the confidential nature of their user profiles. In such case, Fedustria shall take the necessary steps to restore confidentiality.

3. Limitations of the right of use

The right of use is limited in the sense that the user shall refrain from any actions that have or may have a harmful impact on the proper functioning and safety of the website and its other users and/or on its use. The use of the website must not go against these terms of use, applicable legislation, the rights of third parties, or generally accepted Internet code of conduct.

The following actions shall be strictly prohibited:

  • Using software programmes aimed at collecting and obtaining data, including spiders, crawlers, robots and similar software. This list is non-exhaustive.
  • Using the website and its data for spamming, chain letters, junk mail and/or similar variants.
  • Stalking other users and/or trying to convince other users of political and/or religious convictions.
  • Gaining unauthorised access to the user profiles of other users.
  • Using an identity and/or data that are not theirs when registering.

4. Measures

Fedustria reserves the right to take all reasonable and appropriate measures if the user acts in breach of these terms of use and/or applicable legislation, rights of third parties, or generally accepted Internet code of conduct. Fedustria shall have a wide choice as to the sanctioning and remediating measures it may adopt and as to the scope of such measures. However, any measures adopted shall always be in proportion to the breach.

Among others, Fedustria shall have the possibility to suspend the right of use, either temporarily or permanently, and to remove the user profile. In addition, Fedustria shall be entitled to restrict general access and access to functionalities on the website for the user, either temporarily or permanently, in part or in full.

When the circumstances so require, these measures may be taken without any prior warning or notice. In no case shall the user be entitled to any reimbursement or damages for the measures adopted.

If the user is of the opinion that the measure taken is inappropriate or unfounded, they shall make this known to Fedustria within fifteen (15) calendar days after the measure was imposed. Fedustria shall consider the arguments, however without any obligation to revert the initial measures.

5. Limitation of liability

All information on the website is of a general nature. The information is not adapted to the circumstances that are specific or unique to a person or entity. The user must not consider this information as personal, professional or legal advice or similar. Any use made by the user of the information on the website, and of the website itself, shall be entirely at the user's risk.

Fedustria strives for all information to be as complete, correct, comprehensible, accurate and current as possible. Fedustria does not guarantee that the information made available is complete, correct, accurate or up to date. If the user detects incorrect information, they may contact the web administrator.

Fedustria cannot be held liable for any incorrect or erroneous data on the website or in mailings. Even when this is the result of gross negligence or repeated errors, caused by the website, by viruses, computer crimes or cyber crime, and even when Fedustria had been warned of this damage. Fedustria cannot be held liable for any failure or malfunctions of the contacting system. Fedustria cannot be held liable for any transmission of viruses via the website.

Fedustria cannot be held liable for any direct or indirect damage resulting from the use of the information made available on this website or from the use of the website itself.

Fedustria shall at all times be entitled to modify, change and/or complete the content of the website and the website itself without notice or notification. 6. Intellectual property rights

Creativity deserves protection; this also applies to our website and its content. This protection is provided by intellectual property rights and belongs to all owners, i.e. Fedustria and third parties. Content shall be understood to mean the very broad category of photos, video, audio, text, ideas, notes, drawings, articles, et cetera. All this content is protected by copyright, software rights, database rights, design rights, and other applicable (intellectual) property rights. The technical nature of our website itself is protected by copyright, software rights and database rights. Fedustria (TM), its tag lines, logo(s), colour scheme and any trade name we use on our Platform are also protected by the applicable intellectual property rights. We therefore ask our users not to make use of and/or alter any intellectual property as described in this article, without the consent of the owner.

The user undertakes not to breach any intellectual property rights belonging to Fedustria or any other party in any way whatsoever. If the user should commit a breach of intellectual property rights belonging to third parties, this may in no case be attributed to Fedustria. Any actual or legal consequences shall therefore be borne entirely by the user.

7. Protection of personal data

Although most information on the website is available without the user needing to provide any personal data, it is possible that the user is asked for personal information. This information will only be used in the context of our customer management, information provision and the improvement of the user-friendliness of the website. By providing their personal data to Fedustria, users give Fedustria their express consent to process that data for the purposes mentioned below.

Fedustria collects personal data of users, on the basis of the data they have provided on the website, or by filling in a contact form, or via an email message. Fedustria undertakes not to distribute this data to third parties, unless Fedustria is legally required to do so, or is ordered to do so by a court or police authorities. The personal data collected shall be confidential. It will only be used by the internal departments of Fedustria, for the purpose of strengthening or personalising communication, such as letters and/or informative emails, and to keep you informed about our services, and to provide you with any requested information. Fedustria also uses your data for its own marketing purposes.

8. The use of cookies

During a visit to our website, cookies are placed on the hard disk of the user's computer in order to better adapt the website to the needs of users, both new and returning. The cookies are not used to register the user's visitor behaviour on external websites. 9. Miscellaneous provisions

Fedustria reserves the right to modify, expand, reduce or close the website at any time. The exercise of this right does not require prior notice to the user and shall not entitle users to damages.

If the operation or validity of one or several of the above provisions of these terms of use were put at risk, this shall not affect the validity of the remaining provisions of this agreement. In such case, we shall be entitled to amend the provision in question into a valid provision with a similar meaning.

The titles we use in our terms of use are purely illustrative. This means that they do not have any legal value. 

10. Applicable law and jurisdiction

These terms of use shall be exclusively governed by and interpreted in accordance with Belgian law.

In the event of any dispute regarding the performance of this agreement, the parties shall be expected to do everything possible to come to an amicable solution. In the absence of an amicable solution, the dispute may be submitted to an arbitration and mediation centre (such as CEPINA) or a competent court. Any disputes shall fall within the jurisdiction of the courts of the legal district of Brussels.
